The client and the debtor entered into a joint venture agreement to promote a cost-saving initiative for commercial energy users, primarily factories and large warehouses, on behalf of a well-known UK energy broker. 

Each party agreed to pool their marketing efforts and successfully onboarded a number of clients. Both were entitled to a percentage remuneration based on the total energy savings over a multi-year period. The dispute arose when the debtor contended that the joint venture had concluded, while the client maintained that services provided prior to termination entitled them to payment.

How Escalate Resolved – Services Used

While this engagement was complex, involving multiple parties and a substantial volume of data to assimilate, Escalate was able to clearly present the client’s claim to the debtor. The debtor subsequently instructed solicitors to represent them. Ultimately, the parties reached a commercial settlement, resolving the matter without the need for legal proceedings, a result in which Escalate played a key role.
