A software developer was engaged on an annual basis by a national telecoms PLC to provide IT development services, and ongoing support for mobile telephone applications. 

The PLC intended to give notice to the software developer, but had failed to do so in line with the agreed contractual terms between the parties. They then refused to pay and ignored contact with the software developer. 

How Escalate Resolved – Services Used

Escalate quickly established that the PLC was mistaken and that they had no legal basis to withhold payment. We moved quickly to contact key personnel within the business, together with in-house Counsel, providing an articulated legal position, which resulted in the PLC confirming that they had ultimately failed to provide requisite contractual notice to the software developer. The PLC made payment in full, with additional costs and interest, in less than a week.
